Copyright and Licensing

Transfer of Rights

Authors who publish in the Revista Científica El Capacho retain full moral rights over their works, preserving the perpetual recognition of their authorship and the integrity of their intellectual work, in accordance with the fundamental principles of intellectual property recognized internationally. These moral rights include the right of attribution, which ensures that authors are always recognized as the creators of the work, and the right of integrity, which protects against modifications, mutilations, or distortions that could harm the authors’ honor or reputation. The preservation of these moral rights is inalienable and irrevocable, so that, regardless of any transfer of economic rights, authors retain recognition of their academic contribution and the preservation of the conceptual and methodological integrity of their research.

The transfer of publication rights to the Revista Científica El Capacho allows the journal to exercise the powers necessary for the effective dissemination of scholarly work, including reproduction, distribution, public communication, and making content available in digital format through online platforms, indexing databases, and academic repositories. This specific and limited transfer does not constitute a total transfer of economic rights, but rather an authorization focused on the editorial and scholarly dissemination activities required to fulfill the journal’s academic mission.

The transferred rights include the power to reproduce the article in the technical formats required for digital publication, distribute it through academic networks and indexing systems, and include it in compilations or special issues that contribute to the visibility of the published research.

Reuse and Repository Deposit

Authors retain the ability to reuse their work in appropriate academic and professional contexts, maintaining the flexibility needed to incorporate their published research into academic presentations, doctoral dissertations, single-author books, edited collections, and other scholarly dissemination activities that contribute to the advancement of their professional careers and research lines. This reuse right includes the right to deposit versions of the article in institutional, subject-based, or other repositories of their choice, share the work in professional academic networks, use figures, tables, and data in subsequent works, and incorporate concepts and methodologies into future research.

The Revista Científica El Capacho expressly authorizes authors to deposit the following versions of their works in institutional, subject-based, or other repositories of their choice: preprint, accepted version or postprint, and published version, in accordance with the attribution and citation conditions of the original publication. In the case of the preprint, deposit is permitted without any time restriction, provided that it is clearly identified as a manuscript prior to peer review. In the case of the postprint or accepted manuscript, deposit is permitted from the moment of editorial acceptance, including the full bibliographic reference, the DOI when available, and a link to the published version in the journal. The published version may be deposited and shared in accordance with the terms of the license indicated in this policy.

The obligation to cite the original publication is a fundamental requirement that authors must comply with in any subsequent reuse of their work, ensuring proper recognition of the Revista Científica El Capacho as the venue of first publication and preserving the traceability of the scientific record. This citation must include the complete reference of the article, with authors, title, journal name, volume, issue, pages, year of publication, and DOI when available. Compliance with this citation requirement not only acknowledges the journal’s role in the dissemination of knowledge, but also contributes to the impact and visibility of the publication in the international academic ecosystem.

Licensing

All content published in the Revista Científica El Capacho is distributed under the Creative Commons CC BY-NC 4.0 license, an international legal framework that facilitates open access to scientific knowledge while protecting authors’ rights and establishing clear conditions for the appropriate use of scholarly material. This license allows users to share and adapt the published material, provided that appropriate attribution is given, changes are indicated, and the material is not used for commercial purposes.

The license allows copying, distributing, displaying, performing, and modifying the content for educational, research, and other non-commercial purposes. This flexibility includes the possibility of creating translations, abstracts, thematic compilations, derivative educational materials, and critical analyses that incorporate or transform the original content, while always maintaining due recognition of the authors and the journal as the source of publication. When modifications are made to the original material, the nature of the changes must be clearly indicated.

The license prohibits commercial use of the published material, establishing that the content may not be used for purposes whose primary objective is commercial gain or direct economic advantage. This restriction protects the interests of authors and the journal, ensuring that academic work is not appropriated for commercial benefit without appropriate authorization. However, this restriction does not prevent the use of the material in institutional educational contexts, academic research, or scientific dissemination activities that maintain their fundamental purpose of advancing knowledge and education.
